Terms of Service
Last updated: August 12, 2025
These Terms of Service govern your use of PermitSet's architectural permit drawing services. Please read them carefully before engaging our services.
Contents
1. Services Provided
PermitSet ("Company," "we," "us") provides remote architectural drafting and permit drawing services to clients ("you," "Client") across the United States. Our services include, but are not limited to: residential and light commercial permit drawing sets, ADU plans, renovation and addition drawings, deck plans, as-built drawings, and interior design documentation.
All services are delivered remotely. No in-person site visits are included unless explicitly agreed upon in writing as a separate add-on service.
By engaging our services — whether through a quote acceptance, deposit payment, or written agreement — you agree to be bound by these Terms of Service.
2. Scope of Work & Client Responsibilities
The scope of each project is defined by the information provided in your quote request and confirmed in writing (email or project agreement) at the start of work. The scope includes the specific set of drawings and sheets agreed upon.
Client responsibilities include:
• Providing accurate project information, measurements, photos, and site details
• Disclosing any known deed restrictions, HOA rules, or prior plan check comments
• Reviewing draft drawings and providing clear, consolidated feedback within a reasonable time
• Verifying all information before submitting drawings to the building department
PermitSet is not responsible for errors or omissions that result from inaccurate or incomplete information provided by the Client. If project information changes after drafting has begun, additional time and fees may apply.
3. Revisions Policy
Unlimited revisions within the agreed scope are included at no additional charge. "Within scope" means revisions that address the original project description and do not expand the square footage, number of buildings, sheet count, or structural complexity.
Scope expansions — such as adding a new room, changing structural systems, or adding additional plan sheets not in the original quote — will be quoted separately before work proceeds.
Plan check correction support is included. If the building department returns a correction letter related to our drawings, we will revise the affected sheets at no additional charge, provided the corrections address drawing content (not changes to the project scope initiated by the Client after submission).
4. Intellectual Property
Upon receipt of full payment, the Client is granted a non-exclusive, non-transferable license to use the delivered drawings for the specific construction project described in the approved scope of work. This license covers:
• Submission to the applicable building department
• Use by licensed contractors and sub-contractors for construction
• Storage in project records
The Client may not:
• Resell, license, or distribute the drawings as design templates or stock plans
• Use the drawings for any project other than the one specified in the scope
• Remove PermitSet attribution from title blocks without written consent
PermitSet retains the underlying design copyright in all drawing sets. This does not restrict the Client's right to use drawings for the permitted construction project.
5. Payment & Refund Policy
A deposit (typically 50% of the quoted price) is required before drafting begins. The remaining balance is due upon delivery of the final drawing set, unless a different payment schedule has been agreed upon in writing.
Refund Policy:
• Before drafting begins: Full refund of deposit upon written cancellation request.
• After drafting begins but before first draft delivery: 50% of the deposit is refundable. The remainder covers work completed.
• After first draft delivery: No refund is available, as substantial work has been delivered. Revisions within scope will continue to be provided.
• After final delivery: No refund is available.
PermitSet reserves the right to suspend or terminate work on a project if payment obligations are not met within the agreed timeline.
6. Permit Approval Disclaimer
PermitSet produces professional permit-ready architectural drawing sets based on our research of your jurisdiction's codes and submittal requirements. However, we cannot guarantee permit approval.
Building department decisions are made by the Authority Having Jurisdiction (AHJ) and may be influenced by factors outside our control, including: local interpretations of code, inspector discretion, zoning decisions, incomplete scope information provided by the Client, or changes in local regulations between the time of drafting and submission.
Our stated "98% first-submission approval rate" is based on historical projects where the drawings met local code at the time of submission and the Client provided accurate project information. This statistic is not a guarantee of approval for any specific project.
We strongly recommend verifying all jurisdiction-specific requirements before submitting your drawing set.
7. Limitation of Liability
To the maximum extent permitted by applicable law, PermitSet's total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total fees paid by you for the specific project giving rise to the claim.
PermitSet shall not be liable for: indirect, incidental, consequential, special, or punitive damages; permit denials or delays; construction errors by third parties; or losses resulting from inaccurate information provided by the Client.
Nothing in these Terms excludes liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.
8. Governing Law & Disputes
These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules, with proceedings conducted in English.
Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.
9. Changes to These Terms
We may update these Terms of Service from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
For active projects, the Terms in effect at the time of your quote acceptance will govern that project, unless both parties agree in writing to apply updated Terms.
